Focus On Police, Courts, Not Minister Matawalle — Group Tells Bashir Family

A group known as Arewa Concerned Citizens has called on the family of Bashir Hadeija to direct their concerns to the police and the courts, rather than making unsubstantiated allegations against the Minister of State for Defence, Hon. Bello Matawalle.

In August, Bashir Hadeija was arrested by the Nigerian police following intelligence reports that he was involved in smuggling a significant cache of weapons and large quantities of gold, believed to have been stolen from the Central Bank of Libya.

On Wednesday, Bashir Hadeija’s family raised an alarm, claiming that his incarceration in Abuja, which began on Monday, was ordered by the Minister of State for Defence, Bello Matawalle.

Responding to these allegations on Thursday, the National Secretary of the Arewa Concerned Citizens, Muhammed Mustapha, clarified that law enforcement and prosecutions fall under the jurisdiction of the police, led by the Inspector General of Police (IGP), not the Ministry of Defence.

Mustapha emphasized that the case involving Bashir Hadeija is under police authority, and any claims that the Minister of State for Defence had influenced the arrest or prosecution are misguided.

“First and foremost, Hon. Matawalle is not the Minister of Police Affairs and holds no direct authority over police actions,” Mustapha stated.

The family of Bashir Hadeija had earlier alleged that the IGP acted on Matawalle’s directives when arresting Hadeija without a warrant or formal charges. However, Mustapha questioned the plausibility of this claim, asking: “Is it reasonable to believe that the Minister of State for Defence, who has no jurisdiction over the police, could instruct the IGP in such a matter?”

He further explained that the police operate independently under the Ministry of Police Affairs and are responsible for investigating and prosecuting criminal cases.

“It is concerning to see the ease with which people in our society resort to baseless accusations. Hon. Matawalle, like any public servant, should be judged based on facts, not on unsubstantiated claims or attempts at character assassination,” Mustapha added.

“The Hadeija family should focus their grievances on the appropriate authorities, namely the police and the courts, rather than targeting Hon. Matawalle with baseless accusations,” he urged.

Former Benue State governor, Samuel Ortom has declared that he lacks the authority as leader of the party in the state to dissolve the G-14 group, contrary to claims made by Senator Gabriel Suswam and other members of the party. 

Ortom made this declaration during a courtesy visit from G-14 members and other party members from 14 local government areas of Tiv extraction at his Makurdi residence.

The former governor emphasised that the G-14, comprising elders who are united to promote peace and provide direction within the party, is not a party creation, stressing that as such, neither the party constitution nor he, as a leader, has the power to regulate its activities not to talk of dissolution. 

He assured the group that the PDP in Benue State has benefited from their efforts to maintain peace and pledged to continue supporting them.

Ortom called on disgruntled members of the party to resolve differences through internal party mechanisms, rather than causing division. 

He also announced at the gathering that he won’t contest any political office in 2027, citing satisfaction with God’s blessings. 

The former governor warned detractors against intimidation, emphasizing his commitment to equity, fairness, and justice.

Representatives of Kwande elders assured him that the 14 local government areas of Tiv extraction and Benue youths firmly back his leadership, recognising the PDP’s sole authentic secretariat and leadership under Ortom.

FCCPC, NBC Differ On Pay-Per-View For GOtv, DStv

Federal Competition and Consumer Protection Commission ,FCCPC, and the National Broadcasting Commission ,NBC, have informed the Federal High Court, Abuja, about their respective positions on Pay-Per-View subscription requests against Multichoice Nigeria products, GOtv and DStv.

Multichoice Nigeria Limited had asked the court in suit number FHC/ABJ/CS/563/2024 to refuse a plaintiff application seeking to compel it to meter its GOtv and DStv decoders to read customers’ subscriptions only per view or during viewing.

FCCPC and NBC were drawn into the fresh legal dispute by Maduabuchi O. Idam Esq, who sought an order compelling the FCCPC, NBC, and the Attorney-General of the Federation to direct every TV network provider in Nigeria to regulate or meter their subscriptions to read per view or during viewing and to roll over unused subscriptions after the expiration of the subscription duration.

In the suit, the claimant also seeks an order compelling Multichoice to roll over unused subscriptions upon expiration for Idam and other Nigerian customers, allowing them to maximize their investment in its products.

In this latest suit, Idam alleges that GOtv subscriptions, for instance, are not metered and do not account for viewing time; instead, customers are disconnected from service upon the expiration of their subscription, regardless of usage.

Idam states that apart from the alleged arbitrary price hikes that took effect in May 2024, Multichoice does not allow customers to roll over unused subscriptions, preventing them from fully utilizing their purchased services, citing this development as oppressive.

Multichoice denies the allegations of customer oppression, drawing the court’s attention to prior clarifications from Multichoice and other pay-TV operators during meetings with the NBC regarding the feasibility of the Pay-As-You-Go ,PAYG, model, stating that it is not commercially or technically viable in satellite broadcasting due to current technological limitations.

“PAYG has been investigated several times by the National Assembly. In the 8th Assembly, the House Committee on Information, National Orientation, Ethics, and Values, led by Hon. Olusegun Odebunmi, found that allegations of exorbitant Pay-TV subscription charges against Multichoice and the GOtv license holder were unsubstantiated and that the PAYG model is not technically or commercially feasible in the broadcast industry”, Multichoice stated.

In FCCPC’s counter affidavit dated August 16, 2024, and exclusively seen by Nairametrics, Mr. Adedeji Bankole, an officer in the Department of Legal Services of the Commission, countered the claimant’s submission, maintaining that most of the allegations regarding its Pay-Per-View request are incorrect.

Bankole stressed that the FCCPC’s mandate focuses on promoting competition and protecting consumers, but it does not directly regulate how businesses should be run.

He stated that while the FCCPC sets guidelines and enforces laws related to competition and consumer protection, it does not dictate how businesses should be operated or managed.

“The FCCPC is not in any position to direct or compel Multichoice to regulate or meter their subscriptions to read per view or during viewing and to roll over unused subscriptions after the expiration of the subscription duration”, he stated.

He added that the FCCPC has investigated Multichoice several times before and that other subscribers/consumers have taken Multichoice to court in the past over increases in tariffs, and several of those cases are now on appeal.

Still on the matter, Odoeme N.V., representing the NBC, submitted to the court that it received a complaint from the plaintiff dated September 20, 2023, addressed to the Chief Executive Officer of Multichoice TV.

In response to the complaint, it set up a committee to investigate the matter concerning requests for Pay-Per-View, among others.

He stated that Multichoice, through their letters dated October 30, 2023, and April 23, 2024, informed the NBC of their intention to increase the subscription fee.

He continued that the NBC, in its letters dated November 7, 2023, and April 30, 2024, urged and directed Multichoice to suspend the increase while inviting the pay-TV provider for a meeting for further discussion.

“But Multichoice did not honor the invitation. The NBC, on September 28, 2023, wrote to Multichoice to respond to the plaintiff’s complaint, but Multichoice did not respond or make any representation”, he added.

He explained that before the committee established to investigate the plaintiff’s complaint against Multichoice concluded its assignment, the Federal High Court Abuja delivered a judgment declaring that the NBC, not being either the Nigerian Police or the court, does not have the power to investigate or sanction.

The NBC said it is bound by the judgment of the court and cannot presently attend to any complaint against Multichoice for now.

“This judgment forestalled the implementation of the ,NBC, committee’s findings. Owing to the said judgment, the NBC could not take any action in sanctioning or giving directives to Multichoice regarding the plaintiff’s complaint”, the NBC stated in its submission.

AljazirahNigeria has gathered that the court has scheduled December 5, 2024, for a hearing on this legal dispute. Multichoice has faced accusations of exploiting Nigerian customers.

Over the years, the Pay-TV provider has been scrutinized by lawmakers and consumer protection tribunals over its pricing practices.

The hearing follows the Nigerian Competition and Consumer Protection Tribunal’s decision on July 12, 2024, granting a request from lawyer Festus Onifade to withdraw his case against Multichoice Nigeria concerning a price hike of GOtv and DStv subscriptions.

Initially, the tribunal fined Multichoice 150 million naira and mandated a one-month free subscription for violating interim orders, but Multichoice appealed and filed for a stay of proceedings.

The tribunal rescheduled the case to November, but Onifade chose to withdraw the suit, which the tribunal approved without awarding costs.

Multichoice announced new price adjustments for DStv and GOtv packages on Wednesday, April 24, 2024. An email to subscribers stated, “On Wednesday, May 1, 2024, we will adjust our prices across all our packages on DStv and GOtv. We understand the impact this change may have on you, our valued customer but the rise in the cost of business operations has led us to make this difficult decision. How Former Boko Haram Captive Turned Trauma Into Purpose

In this piece, our reporter Blessing Bature analyses the selfless work of a former Boko Haram captive whose selfless work has reduced maternal and infant mortality rates, empowered women with reproductive health knowledge and fostered hope and dignity among IDP communities,

In the midst of displacement and uncertainty, a remarkable story of resilience and compassion emerges, as an unschooled midwife has made a profound impact on the lives of over 5000 pregnant Internally Displaced Persons (IDPs) in Nigeria.

A midwife, popularly known as Aunty Dada, an untrained yet skilled midwife who has dedicated her life to providing critical maternal healthcare to vulnerable IDPs.

Despite lacking formal education, Aunty Dada has delivered over 5000 babies, provided prenatal and postnatal care to hundreds of women, battled limited resources and infrastructure.

With no formal training, Dada learned midwifery skills through apprenticeship and hands-on experience. Her dedication and natural talent have saved countless lives.

Sharing her ordeal, she said she learnt the work when she was captured by Boko-Haram and was forced to deliver several women in the camps. She saw herself working, delivering women day and night without resting.

During her captivity, she was forced to deliver babies for kidnapped women and wives of Boko Haram militants. Despite the traumatic circumstances, she successfully helped these women and their babies survive.

Overwhelmed by the constant demands, she became exhausted. Seeking refuge, she escaped to the IDP camp and began volunteering her skills to help fellow displaced women.

Through her harrowing experience, she discovered her passion for midwifery and now selflessly provides vital care to internally displaced women.

This inspiring story highlights the need for increased support for informal healthcare providers, access to quality education and training and improved healthcare infrastructure for IDPs.

Dada’s remarkable journey inspires us to address the pressing healthcare needs of vulnerable populations.

Explaining the situation of the IDPs, Aunty Dada maternity home said, she has managed the maternity room for 10 years, delivering women and children. “Sometimes, over 120 women give birth here in a month. If I’m not available, women may die due to delays. I’ve been doing this work for years, even performing operations.”

“A woman once came to me after being rejected by the hospital. She had no money, so I helped her. I’ve delivered many babies, and people come to me from all over, even from Igbo. If a woman has had three or four operations, she’ll still come to me.

“I don’t charge fees, and I provide free services. Some women give me 10,000 or 15,000 naira for operations, but I use that money to buy food. I’ve helped over 50,000 women.

“Now, I need the government’s help. I need support for my work, especially with equipment and resources. The hospital here is small, with only one room, and women often give birth on the floor.

“I’m asking the government to assist me with equipment and resources, a bigger, better-equipped facility, and financial support to enable us to continue helping women and children in the community.

Speaking, Special Adviser, Health and Stakeholder Management to the Commissioner, NCFRMI, Dr Fatimah Abdullahi said the Medical Outreach program is crucial for IDPs, as they lack financial resources to access healthcare.

She said in Nigeria, most healthcare services are out-of-pocket expenses, and IDPs are not covered by health insurance.

According to her, “upon visiting this Kabusa IDP camp, we discovered that a traditional birth attendant, TBA, was handling deliveries, despite lacking proper training and skills.

“So we came to this camp and realized there’s one particular traditional birth attendant that attends to the births in this community. Unfortunately, most traditional birth attendants that we know are unskilled, semi literate or even illiterate. So they are not skilled enough to take delivery without complications. So that is what we found here”

She noted the mental health challenges faced by the communities, adding that the Humanitarian Affairs Commission will provide psychosocial support to adults and children.

“To address this, the Humanitarian Affairs Commission, HAC, is committed to establishing a fully-equipped medical facility, providing access to skilled birth attendants and training TBAs for referral and danger sign identification. This falls under HAC’s ‘Health Without Borders’ initiative, focusing on Water, Sanitation, and Hygiene (WASH) malnutrition prevention for children under 5, maternal and Child Health, MCH, and psychosocial support for IDPs, refugees, and migrants

“So one of the things that the HFC has committed to is ensuring that a proper medical health facility is placed here, so that these women get access to skilled birth attendants, and then the traditional birth attendants can then be used for things like referral and identification of danger signs in pregnancy And then referring to these health facilities.”

She said that the commission is ready to collaborate with International NGOs for family planning services, provide supplement provision to combat malnutrition,

She added that family planning services will be integrated into the medical facilities, ensuring access to reproductive healthcare for women in these communities.

“But overall, the Honorable federal commissioners strategy is under a pillar called health without borders. So health without borders looks at several different things. It looks at water, sanitation and hygiene. It looks at malnutrition for children under five. It looks at pregnant women, Maternal and Child Health generally, and psychosocial support.

“So because you know a lot of these IDPs and refugees, migrants faced very difficult conditions, violence, displacements, and the rest of them, they have challenges, like mental health challenges, so they require psychosocial support.

“Our outreach program bridges this gap by providing free medical services, Identifying and treating manageable cases and referring severe cases to specialized hospitals for further care,” she said.

To celebrate Nigeria at 64th which coincided with the Speaker, House of Representatives, Tajudeen Abbas, the National Commission for Refugees, Migrants, and Internally Displaced Persons, NCFRMI, on Tuesday conducted a medical outreach program at the Kabusa Internally Displaced Persons, IDPs, camp in Abuja, the initiative aimed to provide essential healthcare services to vulnerable individuals.

The Commissioner, NCFRMI, Tijani Aliyu Ahmed at the occasion to mark independent day commemoration with IDPs and flag-off distribution of food items at the Kabusa IDPs camp said the outreach was to improve the health and well-being of IDPs, addressing the critical need for accessible healthcare services.

According to him, this was to establish sustainable healthcare solutions, strengthen healthcare infrastructure, and to enhance IDPs’ quality of life.

According to him, “This medical outreach demonstrates the commission’s commitment to supporting vulnerable populations and promoting healthcare access for all.”

He said, “beyond providing medical outreach, food, and clothing, they’re focusing on empowering IDPs through skill acquisition and training programs. The commission aims to provide durable solutions, not just temporary fixes.”

Ahmed explained that the commission is also working to establish settlement cities and provide land for farming projects in states like Nasarawa, Borno, and Plateau. Their goal is to teach IDPs how to “catch fish,” not just rely on aid.

“The National Commission for Refugees, Migrants, and Internally Displaced Persons, IDPs, is working to support IDPs in Nigeria through various initiatives. One such program is in Nasarawa State, Borno, and Plateau, where they aim to cultivate 1000 hectares of land to provide sustainable livelihoods for IDPs. This project is a collaboration between the commission and the Minister of Agriculture”.

“To address healthcare needs, the commission plans to establish a mini-clinic specifically for diabetes care in Kabusa and Wasa. This decision was made after identifying the need for better healthcare services during a visit to Kabusa”.

“The commission has also built a settlement city for IDPs and is working to evacuate them to the nearest center. Education is another key area of focus, with primary schools established in Wasa and plans to build another in Kabusa”.

“The National Commission for Refugees, Migrants, and Internally Displaced Persons is taking proactive steps to support IDPs in Nigeria. To prevent children from roaming aimlessly and potentially getting into trouble, the commission has established primary schools in Wasa and plans to open another in Kabusa. This initiative ensures that children receive education and training, setting them on a positive path, he informed.

“The commission’s core mandate includes protecting and maintaining IDPs, refugees, and migrants, which is a federal government responsibility. To achieve this, they’re focusing on skill acquisition centers in six geopolitical zones. In fact, they’ll soon launch the Skilled Acquisition Center for the North Central zone in Niger State”.

By providing education and skills training, the commission aims to empower IDPs, especially children, to build better futures. This holistic approach addresses the needs of vulnerable populations, ensuring they receive support beyond just basic necessities.

Speaking, Speaker, House of Representatives, Tajudeen Abbas said, “as we celebrate Nigeria’s Independence Day and my birthday, I chose to spend it with you, acknowledging the struggles you face. I want to express gratitude for your patience, support, and faith in our government.

Coalition criticises Gov’t’s inability to inspire confidence On Its Citizens

The Coalition of Northern Groups, CNG, has criticized the government’s inability to inspire confidence among citizens, pointing out that many Nigerians are disillusioned, as evidenced by the muted response to recent independence celebrations.

National Coordinator of CNG, Comrade Jamilu Aliyu Charanchi condemned the current state of Nigeria, attributing the nation’s ongoing crises to poor leadership.

Charanchi expressed deep concerns about the pervasive dysfunction across various sectors, including the economy, security, and health care.

He urged that the key to resolving Nigeria’s multifaceted crises lies in establishing strong, empathetic leadership. Without this change, he warned that the country will continue to face stagnation and decline.

He said: “Nothing is working in this country. Be it the commercial sector, be it economic sector, be it security sector, be it whatever it is, be it communication sector, whatever it is, Nigeria is at a standstill.

“Nigeria is not working. Nigeria is not functioning. Nothing is working. Everything is gradually becoming like a kangaroo agenda in this country. So, it is not by surprise that Zenit Bank is encountering one problem.

“All other banks and banking sectors are encountering such kinds of problems. Even in the communication center, we cannot even communicate with you properly for two minutes. And in the name that we have a country, a country with leaders, leaders that have sympathy for their people, no, that one, nobody will take that.

“That’s why you see even the independence celebration, nobody is even celebrating the independence today. People are even forgetting that Nigeria’s independence was yesterday because they don’t even have the country at their heart, because the leaders don’t even know what they’re supposed to do, because the country is not working.

“So, the solution to our old crisis in this country, whatever crisis you think that we may find ourselves in, be it the social crisis, economic crisis, security crisis, educational crisis, health crisis, whatever crisis you are thinking in this country, the solution is good leadership.

“If we have the desired leadership in this country, then definitely every sector will function effectively, including the banking sector and whatever sector. But as much as we are going to live on this rotten leadership, selfish leadership.”

Nigeria Premier Football League (NPFL) has reached an understanding with a China-based company to establish a presence in the Chinese market and attract investments from the Asian country and also promote closer ties between the league in both countries.

A Memorandum of Understanding was on Wednesday signed at the corporate headquarters of the NPFL which mandates Hunan Galaxy Global Trade Development Company Limited to operate the NPFL office and approach relevant Chinese businesses and other agencies with a view to growing the league’s presence in one of the world’s advanced economies.

Hon Gbenga Elegbeleye,  the NPFL Chairman described the move as a part of continuous efforts to widen the financial base of the league through innovative approaches in administration.

“We are casting our nets near and far to attract investment and sponsorship to the NPFL so that we would be in a position to give more money to our clubs and they would in turn raise the players paycheck. 

“This way, we can retain our best league players here and our clubs can compete well on the continent”, explained Elegbeleye. 

In his speech,  Austin Akpehe, the CEO of Hunan Galaxy and who was represented by Mr. Idowu James, remarked that the MoU was being signed at a time economic and cultural relationship between Nigeria and China is on the uptick.

“We are particularly proud that this partnership is being launched at a time when the relationship between our two countries is stronger than ever. This was recently reaffirmed by the visit of His Excellency President Bola Ahmed Tinubu to China, where he participated in discussions on trade and cooperation aimed at strengthening bilateral ties between our nations”, stated Akpehe.

Continuing, Akpehe declared, “Today, we are laying the foundation for one of these pillars—sports, and more specifically, Nigeria Football Made in China being jointly led by the NPFL and our company. This MOU represents a bold and visionary step to open a representative office that will serve as a bridge, linking Nigerian football, particularly the NPFL with the biggest economy in the world“.

He was optimistic that operating a representative office in China will unlock endless opportunities that will bring Nigerian sports and culture far beyond national shores.

“It will create avenues not only for the exchange of talent and skills but also for global exposure. The NPFL has long been a symbol of the passion and potential within Nigerian football, and now, with this new marketing strategy the new NPFL board under the initiative of the NPFL Chairman Hon. Gbenga Elegbeleye and our company, we are bringing that passion to the heart of China’s thriving football atmosphere”, he reiterated.

It is expected that Hunan Galaxy Global Trade Development Company will in addition to marketing the NPFL to the Chinese market, would also facilitate inter-league relationships that would see exchange of playing tours by clubs of both leagues.

Dam Evaluation: FG Reaffirms Commitment To Flood Mitigation

In its avowed commitment to tackling Nigeria’s flood-related challenges, the Federal Government’s Inter-Ministerial Technical Committe on Dam Evaluation, chaired by the Minister of Water Resources and Sanitation, Engr. Joseph Utsev, held its inaugural meeting on Wednesday.

At the meeting convened to assess the safety and functionality of dams nationwide, Prof. Utsev underscored the recent review of the devastating floods in Maiduguri and surrounding areas which was discussed during the Federal Executive Council (FEC) meeting held on September 23rd, 2024.

FEC had at the meeting emphasized the urgent need for a Disaster Relief Fund to enable a swift response to national disasters in order to minimize the hardships experienced by affected communities.

In a Press Statement after Wednesday’s meeting, Funmi Imuetinyan, the Director, Information and Public Relations of the Ministry of Water Resources and Environment, said the Inter-Ministerial Technical Committee, approved by President Bola Tinubu, has been tasked with evaluating the structural integrity of Nigeria’s dams, assessing their social and environmental impact on local communities, and formulating a comprehensive plan to address the challenges posed by these critical infrastructures.

Prof. Utsev highlighted the committee’s critical objectives, which include evaluating the structural integrity and physical condition of dams across the nation, alongside a comprehensive assessment of the socio-environmental impacts of these dams on local communities. 

Prof. Utsev added that “the findings of the committee will inform the development of a robust action plan to address challenges related to dam infrastructure.”

The Minister also emphasized that the initiative reflects the government’s commitment to proactive disaster risk management and long-term resilience, ensuring the nation is better equipped to handle climate-induced and infrastructure-related hazards. 

He announced plans to establish a Project Delivery Unit (PDU) to provide technical assistance to the committee.

At the meeting, Minister of Information and National Orientation, Mohammed Idris Malagi, stressed the importance of the newly established committee in addressing and mitigating future flood disasters in Nigeria. 

He assured all stakeholders that the committee’s work will follow a strict timeline, reflecting urgency and responsibility. 

Malagi expressed profound gratitude to President Tinubu for his swift and decisive intervention, which demonstrates the President’s unwavering commitment to the well-being of the Nigerian people and resilience against natural disasters.

The Minister of Budget and Economic Planning, Mr. Abubakar Atiku Bagudu, emphasized the importance of the funding provided under the Renewed Hope Infrastructure Fund and the Public-Private Partnership (PPP) initiative for enhancing dams and irrigation infrastructure nationwide. 

He urged all stakeholders to collaborate to ensure the success of this critical initiative, emphasizing that collective support is essential to achieving sustainable improvements.

On his part, the Minister of Finance and Coordinating Minister of the Economy, Mr. Wale Edun, reiterated the government’s commitment to disaster preparedness, announcing that funding has been allocated to every state of the federation for flood abatement initiatives. 

According to Edun, this funding will enhance preparedness for flood events and support the implementation of effective mitigation strategies.

The meeting was attended by the Minister of Water Resources and Sanitation, Engr. Prof. Joseph Utsev; Minister of Information and National Orientation, Mohammed Idris Malagi; Minister of Environment, Mr. Balarabe Abbas Lawal; Minister of Budget and Economic Planning, Sen. Court Dismisses TSTV CEO, Bright Echefu’s Suit Seeking Prohibition Of Police Probe Of Alleged N2bn Fraud

The Federal High Court in Abuja has dismissed the request of the Managing Director and Chief Executive Officer of the Telcom Satellite Television Service (TSTV), Dr Bright Echefu seeking to stop the Inspector General of Police (IGP) from investigating him in an alleged N2bn fraud.

Echefu’s court action against Police investigation into the alleged N2bn fraud was thrown out on Wednesday by Justice Inyang Ekwo for being frivolous and lacking in merit.

In a judgment in the suit marked FHC/ABJ/CS/234/2024, the Judge held that it was wrong of the TSTV CEO to seek court protection to shield himself from being probed over a petition against him on alleged stealing and misappropriation of the sum of N2bn investment fund into TSTV.

The petition against Echefu was authored by a former Minister of Special Duties, Kabiru Turaki, a Senior Advocate of Nigeria (SAN) who alleged that his N2bn investment fund into the TSTV had been fraudulently tampered with.

However, upon his summon by Police for explanation into the allegations against him, Echefu had rushed to the federal high court praying for an order to prohibit the Inspector General of Police and his agents from looking into the allegations.

He also sought an order against the Deputy Inspector General of Police (DIG) in charge of Force Bureau of Criminal Investigation from conducting investigation into the finances of TSTV under his watch.

The grouse of Echefu was that Kabiru Turaki’s N2bn investment fund was a civil transaction and that police have no power under any known laws to investigate such transactions.

Specifically, the TSTV CEO kicked against police invitation to him on the ground that police cannot act as debt recovery agent for the former minister.

However after reviewing his claims and counter claims by Police, Justice Ekwo said that the allegations against Echefu was on stealing and misappropriating N2bn investment fund and not debt recovery drive as he erroneously held against police.

The Judge said that section 4 of Police Act 2020 was so clear as to the statutory powers to investigate such alleged fraud adding that prohibiting police from doing so, as requested by the TSTV CEO, would amount to a judicial victory for the undeserved.

Justice Ekwo held that the TSTV CEO failed woefully to establish his claims of civil matter involving N2bn loan transaction whereas the petition before police was on alleged stealing and misappropriating the huge sums invested into the Company for its expansion.

The Judge disagreed with Echefu that police have no power to investigate such petition against him adding that when a petition has colour of stealing and misappropriating, police are empowered under section 4 of Police Act to inquire into such allegations.

“The plaintiff (Echefu) has not denied being given the several sums of money by the 4th defendant (Kabiru Turaki) as investment in the companies mentioned in the averments in this case.

” The case made against the plaintiff (Echefu) is that of stealing and misappropriation. For the plaintiff to assert and actually sustain the assertion that this matter is contractual and that police cannot be involved, the onus is on the plaintiff to demonstrate with concrete evidence that there was no stealing and misappropriation.

“This is so because the mere claim that a relationship between the parties was and is contractual in nature is not a magic wand that will indiscriminately shield a person from being investigated on the allegations of criminal act arising from civil transaction”.

“To allow a plaintiff to coast home with the treasures of his loot on the grounds that such was contractual matter, will enhance a judicial victory for the undeserved.

“A citizen who is a victim of any act of crime, has right to make a report of same to the police and in the Nigerian system of administration of justice, when a crime is committed, it is the Nigerian police that moves in to investigate it.

“On the whole, the plaintiff has not given me any cogent ground to interfere in the exercise of the statutory power of the 1st and 2nd defendants (Police) on the petition by the 4th defendant (Turaki) that his investment has been stolen and misappropriated by the plaintiff.

“On this ground, I find that this action lacks merit and ought to be dismissed. I therefore make an order dismissing this case on those grounds.

Defendants in the suit are the Nigeria Police Force, IGP, DIG Force Investigation Bureau, Kabiru Tanimu Turaki SAN and Attorney General of the Federation as 1st to 5th defendants respectively.

The Judge had earlier struck out the name of the AGF on the ground that no relief was sought against him by the plaintiff.

House of Representatives, has rejected Commander of the Federal Republic, CFR, award conferred on the Speaker, Honourable Tajudeen Abbas, by President Bola Ahmed Tinubu.

Tinubu, on the occasion of Nigeria’s 64th Independence anniversary celebration honoured notable Nigerians with the conferment of Grand Commander of the Order of the Niger, GCON on President of the Senate and the conferment of the Commander of the Federal Republic, CFR, on the Speaker of the House of Representatives and Deputy President of the Senate.

The House expressed its dismay in a motion entitled, “multi-partisan motion on the inappropriate discrimination against the House of Representatives and the presentation of the chamber as inferior to the Senate”, moved at the plenary yesterday by Hon. Philip Agbese and co-sponsored by 235 and backed by 359 lawmakers.

Agbese, said that there was an ongoing discrimination against the House of Representatives, in a manner portraying the Senate as superior and the House as inferior through the use of “upper chamber” and “lower chamber”, referring to Senate and House respectively.

He also said that the National Assembly was constitutionally established as a bicameral legislature comprising two equal chambers – the Senate and the House, as stipulated in Section 4 of the 1999 Constitution of the Federal Republic of Nigeria (as amended), with both chambers operating within a framework that ensures the legislative independence and equality of each.

The lawmaker maintained that Speaker Abbas is a co-leader of the legislative arm of government, and this must be recognised and respected in all ramifications.

Section 47 of the 1999 Constitution provides for the establishment of the National Assembly, consisting of the  Senate and the House of Representatives, each of which plays distinct but complementary roles in the legislative process.

“While expressing our gratitude to Mr. President for recognising and honouring the leadership of the National Assembly, we note that the conferment of the title of Grand Commander of the Order of the Niger, GCON, on the President of the Senate and the conferment of the Commander of the Federal Republic, CFR, on the Speaker of the House of Representatives and Deputy President of the Senate perpetuates the inappropriate subordination of the Speaker to the President of the Senate”.

The House resolved: “Call attention to the ongoing discriminatory practice of referring to the Senate as the “upper chamber” and the House of Representatives as the “lower chamber,” as well as portraying the Speaker as subordinate to the President of the Senate.

“Such references undermine the equal status of both chambers as established by the Constitution and diminish the standing of the House of Representatives in the legislative process.

“Affirm that the House of Representatives is an independent and equal chamber of the National Assembly, and the Speaker is a co-head of the legislative arm of government alongside the President of the Senate. (Power of the purse)

“Recognise the Speaker of the House of Representatives as co-chairman of the National Assembly in all respects, and request that all references to the leadership of the National Assembly reflect this equality.

“Call on all government institutions, officials, and the media to take cognisance of language and titles that suggest a hierarchical structure between the Senate and the House of Representatives or their respective leaders”.

“Mandates the relevant House Committees to liaise with the Presidency and propose amendments to the National Honours Act of 1964 to appropriately recognise the Speaker of the House of Representatives as co-head of the National Assembly and, accordingly, confer the national honour of GCON upon the Speaker, ensuring parity in recognition with the President of the Senate. This should be accomplished before the formal decoration by Mr. President”.
