FG Begins Implementation Of Zero VAT, Excise Duties On Pharmaceutical Products

The Federal Government has announced the commencement of zero Value Added Tax, VAT, on pharmaceutical products and medical devices in a bid to reduce drug prices in the country.

In a statement signed by the Head of Information in the Federal Ministry of Health, Alaba. R. Balogun, noted that the Executive Order on harmonized implementation framework has been cleared to be gazette.

Furthermore, the Ministry noted that following the completion of the process, the Federal Inland Revenue Service, FIRS, and Nigeria Customs Service, NCS, can now begin implementing zero VAT and excise duties on pharmaceutical products and medical devices.

It also stated that local manufacturers of pharmaceutical products will now begin to benefit from the relief measures.

It stated, “The Ministry of Health and Social Welfare is pleased to announce the finalization of the Executive Order Harmonized Implementation Framework, which has now been cleared for gazetting. This critical step ensures that the Federal Inland Revenue Service , FIRS, and the Nigeria Customs Service can proceed with the implementation of zero VAT and excise duties on pharmaceutical products and medical devices”. 

“With the implementation of this Executive Order, we anticipate a notable reduction in the prices of essential pharmaceutical products and medical consumables. This development aligns with the Ministry’s unwavering commitment to reducing both the physical and financial pain faced by millions of Nigerians who depend on these critical health supplies”.

It was noted that the gazetting of the Harmonized Implementation Framework represented the realization of the third pillar of the Ministry’s 4-point agenda, which focuses on unlocking the healthcare value chain.

Earlier in June 2024, President Tinubu signed four Executive Orders to implement zero tariffs, excise duties, and VAT on specialized machinery, equipment, and pharmaceutical raw materials to enhance local production of essential healthcare products.

The initiative was targeted at pharmaceuticals, diagnostics, medical devices like needles and syringes, biologicals, and medical textiles, aiming to significantly strengthen Nigeria’s healthcare value chain.

However, the Minister of Health and Social Welfare, Prof. Muhammed Pate noted that the orders will help reduce drug prices across the country.

Following the exit of major pharmaceutical manufacturers like GSK and Sanofi from Nigeria and the depreciation of the Naira, the prices of drugs skyrocketed across the country. This made healthcare expensive for many Nigerians especially the most vulnerable.

The prices of drugs such as ventolin inhalers, Augmentin, and others spiked by almost 1000% last year following the exit of GSK.

DSS Indicts ‘CBN Staff’ For Aiding Anchor Borrowers’ Funds Fraud

Nigeria’s Department of State Services , DSS, has disclosed how several staff members of the Central Bank of Nigeria, CBN, allegedly aided in the theft of public funds through the federal government’s Anchor Borrower Programme, ABP, established under former President Muhammadu Buhari.

The DSS’s allegations, presented in a counter-affidavit, responded to a lawsuit filed by Ansar Technology Nigeria Ltd and its management one of the anchors for participation in the agricultural program.

Ansar had sued the DSS and the Director of the Directorate of Proceeds of Crime Recovery & Management, DPCRM, State Security Service, in an originating summons marked FHC/ABJ/CS/1274/2023, insisting that the security agency lacks the power or privilege to subject the plaintiffs to investigation or prosecution for any act or omission that does not violate or endanger Nigeria’s internal security.

The plaintiffs emphasized before the court that the DSS allegedly does not have the statutory power to recover the debt arising from the time loan facility granted to them by Keystone Bank Ltd under the CBN’s Anchor Borrowers Programme in 2021.

The plaintiffs’ counsel, Godwin Chigbu Esq, urged the court to declare that the Anchor Borrowers Programme executed by the CBN under President Muhammadu Buhari’s administration and the company’s participation in the program do not constitute a criminal offense under Nigerian law, thereby warranting the DSS’s investigation, arrest, detention, or prosecution.

Aminu Haruna, Administrative Officer of Ansar, explained in an affidavit dated September 15, 2023, that in 2020, after following all required procedures, his company was qualified by the CBN for a credit facility under the CBN’s Anchor Borrowers Programme to enable it to cultivate 20,000 hectares of rice farmland.

He stated that Keystone Bank Ltd was one of the banks participating in the Anchor Borrowers Programme as a Participating Financial Institution (PFI), whose functions included verifying the capacity and suitability of the anchor (in this case, the first plaintiff) to participate in the programme.

He added that the bank recommended the anchor for participation in the programme, including granting loan facilities while supervising the project from inception to completion.

He stated that his company secured 10,000 hectares of farmland in Gunmi and Bukkuyum communities in Zamfara State and 10,000 hectares in Jigawa State for the project, with relevant stakeholders visiting these locations at various times for inspections from inception until the events that imperiled the project occurred.

He noted that after assessing the company’s preparedness and suitability for the project, Keystone Bank Ltd approved a loan facility of N4,807,500,000 under the CBN’s Anchor Borrowers Programme as a time loan to the company for project execution.

“Out of the loan amount of N4,807,500,000, the first plaintiff was only able to access a portion for the execution of the project”, he stated, adding that before the rice matured for harvest in the Zamfara State farm around April and May 2021, insecurity, kidnapping, and banditry intensified in the area, making it unsafe for the company and its workers to continue farming activities.

“Thus, the investment in the Zamfara farmlands became a total loss”, he explained, noting that relevant stakeholders, including staff of Keystone Bank Ltd, were allegedly aware of the situation.

He claimed that Keystone Bank Ltd had provided Veritas Kapital Assurance Plc as the insurer of the company’s farms under the program, and Ansar paid the insurance premium as demanded by Keystone Bank Ltd and Veritas, thereby entering into an insurance contract.

“When the farms were imperiled as described above, the plaintiffs contended that Veritas should fulfill its obligations under the insurance contract; or alternatively, Keystone Bank Ltd and Veritas Kapital Assurance Plc should be responsible for repaying the loan since the primary source for repayment had failed due to reasons that fall within the insured events. 

“Keystone Bank Ltd and Veritas resisted the plaintiffs’ contention, leading to disputes over who should be responsible for repaying the loan”, he submitted, adding that the plaintiffs, Keystone Bank Ltd, and Veritas could not amicably resolve the issue of liability for loan repayment, prompting them to institute a suit at the FCT High Court to determine who should repay the loan.

He stated that despite the pending suit, to the knowledge of the DSS, its officials have continued their debt recovery efforts against the plaintiffs, prejudicing the said suit.

He urged the court to hold that the issue of non-repayment of the loan is purely a civil matter and does not have a criminal aspect.

Eno Uso-Essien, female personnel of the State Security Service, SSS, attached to the Directorate of Proceeds of Crime Recovery and Management, National Headquarters, Abuja, deposed in a sworn affidavit that the defendant’s mandate includes detecting, preventing, and investigating economic crimes of national security dimension, as well as any activities that could sabotage the country’s economic development.

The official stated that a Joint Committee was also constituted, comprising the Economic and Financial Crimes Commission,EFCC, Nigerian Financial Intelligence Unit,NFIU, Code of Conduct Bureau, CCB, Federal Ministry of Justice, FMoJ, and the Independent Corrupt Practices and Other Related Offences Commission, ICPC, for this purpose.

She submitted that upon the commencement of the investigation by the Committee, the Central Bank, Participating Financial Institutions, PFIs, and beneficiaries were indicted in the preliminary investigation.

According to the official, some of the indictments included overriding the laid-down guidelines to favor particular beneficiaries, deliberate delays in disbursing funds by PFIs, and beneficiaries collecting money from farmers out of season and in areas unsafe for cultivation due to insecurity.

She noted that all beneficiaries indicted in the preliminary investigations were invited through their PFIs to enable the committee to ascertain the veracity of the allegations against them.

She said the plaintiffs were indicted for overriding the guidelines and accessing funds for farmers in Gunmi and Bukkyum communities in Zamfara State, areas not easily accessible due to insecurity, and for preparing documents for their defense.

Explaining the role of the CBN, the deponent stated that the CBN and PFIs were also indicted “for insisting that beneficiaries insure their farms with particular insurance companies that lacked capacity, and for which a very meager amount was paid as a premium”.

“Ansar is suspected to be one of the conduits for the pilfering of public funds through the Anchor Borrower Programme, ABP, by the staff of the Central Bank of Nigeria”, the DSS stated in its affidavit.

The DSS added that the plaintiffs were aware of the challenges posed by sustained insecurity and flooding in Zamfara and Jigawa, where they intended to farm, but deliberately collaborated with officials of the Anchor Borrower Programme, including CBN staff, to override the guidelines and access the time loan with no intention of repaying it.

The DSS accused the plaintiffs of instituting the suit solely to prevent the Committee from discharging its statutory mandate, attempting to use the court to hinder the DSS’s ongoing national financial crime investigation.

“The investigation has assumed a wider dimension, and other collaborators identified during the investigation will be prosecuted. The activities of the plaintiffs constitute a potent threat to national security and economic policy, affecting the President of Nigeria’s renewed hope agenda in the area of food security.  

“It would not be in the interest of justice and national security to grant the defendants’ relief”, the official responded.

AljazirahNigeria gathered that the case came before Justice Inyang Ekwo on October 2, 2024, and was adjourned to November 20, 2024, for further hearing.

Aljazirah Nigeria reached out to the Principal Manager at the ,CBN, Corporate Communication Department, Mr. Olalekan Ajayi, for his reaction.

However, obtaining his views was unsuccessful, as he maintained that the matter is still pending in court.

The Anchor Borrowers Programme ,ABP, of the CBN was established in November 2015 with the objective of creating economic linkages between Smallholder Farmers ,SHF, and anchors.

The current suit follows a presidential directive to the DSS to investigate economic crimes of national security dimension carried out through the Central Bank of Nigeria.

The mandate of the Joint Committee includes investigating the sharp practices identified in the execution of the Anchor Borrower Programme among other issues by the Central Bank of Nigeria through the Participating Financial Institutions ,PFIs.

The House of Representatives initiated an investigation into the N1.12 trillion Anchor Borrowers Scheme, a federal government initiative for agricultural funding through the CBN.

The probe was mandated to include the Nigeria Incentive-Based Risk Sharing System for Agricultural Lending ,NIRSAL, the Bank of Industry ,BoI, and other agencies.

This decision followed the adoption of a motion by Hon Chike Okafor (APC-Imo) yesterday. Okafor attributed the increasing food scarcity and malnutrition in Nigeria to the alleged mismanagement of agricultural funds intended for development.

On April 8, 2024, the CBN dismissed five to eight directors. Those affected were from the Trade and Exchange Department, Securities Department, Development Finance Department, Purchasing and Support Services Department, and Public Affairs Department, Nairametrics previously reported.

The apex bank had dismissed over 110 staff members across its 27 departments, according to multiple sources.

CBN insiders previously told AljazirahNigeria that the dismissed staff members were those who played active roles in management under former CBN Governor Godwin Emefiele.

In particular, the Development Finance Department has been heavily affected by the dismissals. Insiders said those retrenched directly or indirectly managed development funds such as the Anchor Borrowers Scheme,ABP, Real Sector Support Facility ,RSSF, Micro, Small and Medium Enterprises Development Fund ,MSMEDF, and the Agricultural Credit Guarantee Scheme.

Insiders informed our reporter that Cardoso is upset with how staff members have betrayed the central bank in the management of the ABP.

Halilu Tasks Procurement Officers on High Level Procurement Expertise

Executive Vice Chairman/CEO, National Agency for Science and Engineering Infrastructure (NASENI), Mr. Khalil Suleiman Halilu, has said that achieving the Agency’s goals require a high level of professional proficiency and technical expertise in procurement management. This call, Halilu said, is essential in order to achieve the overall mandate and goals of the agency.

In his welcome address at the opening of ceremony of the 2024 three-day in-house training for procurement officers and other participating staff from NASENI system-wide, which commenced on Tuesday in Abuja, he stated that the Agency wanted to be the best in everything it does in order to deliver quality services to achieve the overall goals of Mr. President’s Renewed Hope Agenda.

The EVC/CEO while highlighting the importance of the training, said it was designed to equip officers involved in procurement with the professional capacity needed to manage NASENI’s procurement processes effectively and in full compliance with the Public Procurement Act 2007.

While assuring that NASENI was committed to complying with everything outlined in the Act, he said “the importance of the workshop cannot be overstated, particularly for newly hired or deployed officers. It is essential that incumbent officers are trained and retrained to align with NASENI’s vision and mandate.”

He admonished participants to put into practice what they would learn in their daily work to make a difference in how they carry out their roles and responsibilities, he urged them to take the training serious and gain from the extensive knowledge and experience of the resource persons, leading to improved service delivery.

Also, in his keynote address Ag. Director-General, Bureau of Public Procurement (BPP), Barr. Olusegun Omotola represented by the Director of Training, Dr. Adebowale Adedokun, said NASENI has a crucial role in national infrastructure development thus building skills and competencies are critical for the execution of transparent and efficient public procurement which guarantees good value for money.

He noted that every government agency must comply with the Secretary to the Government of the Federation (SGF) Circulars on procurement plans and procurement records and that no procurement process could commence without properly approved procurement plan via the use of the NOCOPO system and must have a full-fledged procurement department/unit/division manned by BPP trained/certified officers.

In addition, he urged NASENI to be very thorough and careful in the discharge of its responsibilities in the public procurement process with the highest sense of accountability, ethics and integrity, saying it is expected that at the end of the training, all factors militating against effective performance of procurement related activities and budget implementation would have been addressed.

Harmonization Of Effective Intelligence As A Veritable Tool For Fighting Threats To Security And Stability

In light of the glaring security challenges confronting the nation there is a dire need for holistic harmonisation of intelligence gathering, intelligence dissemination and intelligence co-ordination among the various security agencies tasked with this endeavour e.g. the Directorate of State Security (DSS), the National lntelligence Agency (NIA), the Directorate of Military lntelligence (DMI) and other allied agencies. This harmonisation process will ensure that intelligence that is required for operational, tactical and logistical purposes are given the priority they deserve and get to the end users in real time so that they can be acted upon promptly and decisively. The lack of harmonisation and co-ordination of intelligence gathering and dissemination has hindered the effective prosecution of the fight against terrorism, insurgency, kidnapping, banditry, separatism and militancy across the nation.
Thus the reform of Nigeria’s intelligence apparatus would improve public confidence, harmonise intelligence operations, and enhance the security agencies’ ability to detect, isolate, and degrade threats to public safety.

Going down memory lane, the military authorities passed the National Security Agencies Decree now Act in 1986 that established three intelligence services: the State Security Service (SSS) for domestic intelligence, the National Intelligence Agency (NIA) for foreign intelligence, and the Defence Intelligence Agency (DIA) for military intelligence activities within and outside the country.
The State Security Service which has morphed into the Department of State Services (DSS) is saddled with the responsibility of homeland intelligence operations and counterintelligence as well as the protection of sensitive installations, senior government officials, and visiting dignitaries. Other assignments include preventing and detecting crime and countering threats from terrorism, conflicts, and economic crimes of the national security dimension.

Over the past two decades, the nation’s intelligence services has faced fresh challenges that requires the adoption of new methods for intelligence assessment and tactical operations in response to threats such as those posed by Boko Haram, lslam State West Africa Province ( lSWAP), ethnic militias, economic saboteurs, separatists, cyber criminals and advance fee fraudsters.

The existence of these hydra-headed security challenges led to investments in non-kinetic and kinetic capabilities for counterterrorism activities including intelligence gathering, digital forensic investigations, as well as independent and joint targeted raids with the military to arrest terror suspects, neutralise cells, and promote disengagement.

The investment in technology products for intelligence monitoring, collection, and processing has become one of the pivotal tools for counterterrorism assessment operations alongside the traditional gathering of information through human assets ( humint). However, there are still observable gaps in ground and airborne capabilities for signal (SIGINT) and geospatial intelligence (GEOINT) to gain crucial tactical and strategic advantages against insurgent groups. This is in addition to shortcomings in the processing of available intelligence.

The gaps in intelligence gathering and dissemination is evident in the absence of robust predictive modelling for identifying security challenges and the heavy reliance on the armed forces for operations against threats that ideally should be managed by intelligence-led law enforcement without creating situations for escalation. The persistent use of the military for internal security has had unintended consequences including continuous military involvement in areas in the Niger Delta, Northeast, Northwest, North-central, and the Southeast regions of the country.

The tendency to employ a hard approach through the military to suppress protest or conflict could be traced to military era habits and the composition of the top security management team, including the tradition of appointing former military officers as National Security Advisers (NSA) to the President. The NSA is a principal staff officer responsible for making sure the president has the best intelligence to make decisions on national security. However with the appointment of Mallam Nuhu Ribadu, DIG (rtd) by President Ahmed Bola Tinubu to head the NSA, the agenda will likely shift from a military style approach to a more systematic regime that relies more on intelligence gathering than the heavy handed approach that tend to even inflame feelings and underlying resentment for the authorities. Since taking office in June 2023, Mallam Nuhu Ribadu has enthroned a refreshing atmosphere of inter-agency cooperation, co-ordination and cohesiveness, which is a striking departure from the inter-agency rivalries and undue competition that existed in the past. Regular meetings, briefings and brainstorming sessions are constantly convened involving all heads of the relevant security and intelligence formations with the sole aim of harmonising available data, info and intel needed to defeat the criminal and terrorist networks within and even outside our shores. A purposeful Mallam Ribadu has emphasized that the urgent task at hand remains the decimation of criminal networks and their sponsors in order to restore security, stability and tranquility nationwide; any other agenda is secondary. And there are clear signs that this single minded focus and clarity of direction is achieving the desired results given the fact that all manner of terrorists, kidnappers, bandits and their dastardly collaborators are being neutralized and apprehended on a daily basis. The dramatic rescue of over 300 abducted Chibok girls also point to an overwhelming triumph of the newly adopted intelligence harmonisation desiderata of the amiable NSA supremo.

Thus the ongoing reforms of Nigeria’s intelligence community will strengthen participation in counterinsurgency operations and build a well- bonded system to effectively respond to today’s changing security scenario. It will also enhance the forecasting and prevention of security threats by influencing the decisions of policymakers at different levels of government. The ongoing recalibration of the nation’s intelligence apparatus will also allow the agencies to build capacity in response to the diverse security risks and intelligence gathering potentials related to cyberspace and the internet thus enabling them to provide lasting peace, security and stability and bring a definitive end to security threats, breaches and challenges across the nation once and for all. 23 PDP Party Chairmen in Benue Endorses Utaan as Sole Candidate to Replace Ayu Ahead National Convention

Elected Party Chairmen of the Peoples Democratic Party, PDP, for the 23 Local Government Areas of Benue State, has endorsed, Conrad Utaan as the sole nominee of the PDP to replace Iorchia Ayu, who was removed from office by his council ward exco for nonpayment of Party dues.

Speaking at a press conference held Wednesday in Makurdi, spokesperson for the group, Adigo Terseer, said that critical stakeholders and key components of the PDP United under a common forum decided that for the party to re-discover its true identity and take back its pride of place, as the most viable political party in Nigeria and Benue in particular, decided to take the lead to ensure that the laws of the party are implemented above groups and individual interest.

Adigo also the PDP Party Chairman of Katsina-ala LGA equally affirmed that,only when bold and courageous decisions by doing what is right is done that PDP will be revived and made functional as a political party which will once again be attractive to Nigerians.

He said when they took the oath of office and allegiance on the assumption of office, they pledged to do the right thing always by giving absolute loyalty to the party above other considerations, arguing that in fulfillment of the oath, by section 47(6) of the PDP constitution 2017(as amended to replace Iorchia Ayu with Conrad Utaan which is in line with the Constitution that state’s that replacement must be from the area of the outgoing Chairman, to reinforce the party’s commitment to equity, justice and fairness which its core principles.

They recalled that when, Barnabas Gemade and Audu Ogbe both from zones A and C previously served in the office of the National Chairman and after their tenure Iorchia Ayu took the tone of zone B but could not complete his tenure, insisting that for equity, fairness and justice not to be fulfilled halfway, Ayu’s replacement should come from Benue North- West and the only aspirant from the zone Utaan replace Ayu as sole candidate of the PDP as National Chairman.

The group further opined that they decided to add value to the agitations from Benue State and North Central Region for Ayu’s replacement as National Chairman, adding that their decision would be communicated to the State Working Committee, SEC, for onward transmission to the zonal executive committee, ZEC, for North Central for it to transmit same to the National Executive Committee for their affirmation as a replacement for Ayu as National Chairman of the PDP.

Governor Alia Sets Up Forensic Audit Panel for Lobi Stars FC

Benue State Governor, Reverend Father, Hyacinth Alia, has established a forensic audit panel to investigate the financial affairs of Lobi Stars Football Club.

Alia disclosed this Tuesday when he received Daniel Amokachi, the new Technical Adviser of the club at Government House Makurdi.

The governor in a statement by Head of Media of the club Emmanuel Uja, in Makurdi, said he took the decision based on persistent complaints of non-payment of salaries to players and officials, despite government financial obligations to the club.

 He praised Amokachi’s international football career and urged him to improve the club’s performance.

The governor named members of the Audit Forensic team to include, including Sam Chir,  Bishop Dzungwe, and Akpusugh Terungwa all Assistant Directors of Audit in the Benue State Department of Audit, and Abraham Gberindyer the Auditor General were charged with the responsibility of investigating the club’s financial affairs

Responding Amokachi, a former Super Eagles player, expressed gratitude to the governor and the people of Benue State for the warm reception.

He emphasized the importance of paying players’ salaries, citing it as a significant motivation for the team to excel in the football league, and promised to do his best to improve the club’s performance.

In a remark Philip Nongu, Chairman of Lobi Stars FC, said he was in Government House Makurdi to present to the Governor, the new Technic adviser of the club.
