Court Adjourns Nasarawa West APC Senatorial Primary Case To July 22

The Federal High court sitting in Lafia, the Nasarawa State capital, on Wednesday adjourned a case filed by Barrister Labaran Shaibu Magaji, a senatorial aspiriant of the APC, Nasarawa West senatorial zone challenging the outcome of the senatorial primary election held on June 4, 2022 which was in favour of  Arc. Shehu Tukur.

Justice Nehizina Idumudia-Afolabi, who is the presuding judge, said the case was adjurned to July 22, 2022 due to the delay of submission of memorandum of appearance before the court by the defendant.

She, however, warned both counsels not to take the rule of the court for granted and avoid ground standing and playing to the gallery so as to save time.

 Her words, “This is pre-election matter, it is time bound and warned them to avoid frevolous ground in the matter”.

In a suit number FHC/LA/11/2022 against the national secretariat of the party and 10 others contesting their involvement in the primary election for Nasarawa West which was alleged to be marred by irregularities ranging from list of fake delegates.

In an interview with our correspondent shortly after the adjournment, the defence counsel to the APC, Oboshi Ogu pleaded with the presiding Judge to adjourned the matter to enable them intensify effort to access some documents.

He affirmed that the issue at stake was an intra party issue.

AljazirahNigeria reports that defendants in the case are Arc.Shehu Tukur, the Independent National Electoral Commission (INEC), State and National Chairmen of ruling All Progressives Congress (APC) Senator Abdullahi Abbas, Alh. Yakubu Mohammed Soja, Mr Yusuf Adamu Auta, Major General AT Jibrin (rtd) and Princess Miriam Onuoha.

Also speaking to our correspondent, the counsel to the plaintiff, Barrister Gali Umar-Ahmed stated that they are challenging the defense counsel for not serving them memorandum of appearance.

The plaintiff, however, opined that combined total of 125 votes in favour of the 2nd defendant by the purported delegates from Nasarawa and Keffi LGAs was liable to be expunged from the total of 179 votes recorded for the 2nd Defendant at the primary election conducted on the 4th day of June 2022.

He argued further that any congress to elect delegates pursuant to article 13.13 (III) of the APC constitution (as) amended 26 March, 2022) could only produce one delegate list for the purpose of any primary election to norminate a senatorial candidates pursuant to paragraph 22(11)(A/ of the guidelines for the normination of candidates for the 2023 general election.

It will be recalled that the appeal committee of the party had recommended that a new primary election should be conducted or on the event of time constraint he Labaran Shaibu Magaji should be declared the winner of the primary election based on the genuine facts and figures he presented before the committee.
